LEGAL TERMS OF TICKETS PURCHASE ONLINE THROUGH THE WEBSITE
You are making a commercial transaction with CONCERTS ESTUDIO SL (from now on, THE ORGANIZER) with CIF B-61.500.211. Its address is C/ Moià 14, 08006 Barcelona (Spain). You can contact our entity through the email[email protected] or the 933632510 landline in office schedule to take care of the public.
Following the rules established by the 10th article of the Law of Services of Information and Electronic Commerce Society (Law 34/2002) we inform you that THE ORGANIZER is a limited society and its domain has been inscribed in the file 027/0412, volume 30230, sheet B 169300, inscription 1 of the Mercantile Register.
We understand that the tickets sale is done in our social address, and purchasing the ticket means accepting the general conditions at the time of the purchase.
The following conditions aim to establish the terms as well as to explain the details of the ticket purchase operation by the users who choose to do their purchase through this system, as well as the rights and obligations attached to the ticket/s that are purchased.
1. GENERAL FEATURES
THE ORGANIZER offers to anybody the possibility of purchasing tickets through Internet in order to attend the different shows that it organizes. The Internet users who access the ORGANIZER website and, specifically, this section of tickets purchase, assume voluntarily and compromise to respect the terms and conditions of the purchase contract, and to submit to them. The terms are specified here.
2. FORMALIZATION OF THE SALE
When the user gives the order of purchase of one or more tickets, he will be considered “buyer”, and will be obliged as such towards the ORGANIZER, who will have the seller condition. The purchase done through Internet by the BUYER and received by the ORGANIZER has a binding contractual character.
The BUYER must fill in correctly and totally the data requested and compromises not to introduce other people´s data. The ORGANIZER will confirm the receipt of the purchase order through email or other media with no delay, and from that moment on, the sale will be completed and both sides will have the obligation to follow the agreement.
3. GENERAL CONDITIONS GOVERNING TICKET BUYING AND SELLING THROUGH THIS WEBSITE
Purchasing the ticket /s means that the buyer accepts the following General Conditions:
A) The ticket has several safety measures. However, the ORGANIZER doesn’t guarantee its authenticity if it hasn’t been purchased in one of the official selling spots. Any amended, broken, fake-looking or illicitly purchased ticket will authorize the Organization to deny the entrance to its bearer. In these cases, if he/she is not allowed the access to the premises, the Organization accepts no responsibility. In order to enter, the ticket must be entire and in good condition. The ticket has to be kept until exiting the premises.
B) The biggest amount of tickets, the price and placing of them will be chosen by the buyer during the purchasing procedure and no alterations will be allowed once the purchase will have been completed.
C) The ORGANIZER´s official website ticket purchase system has a ticket printing service which allows (i) to print the ticket after the purchase has been completed (downloading a PDF file) or (ii) to store the file in the computer in order to print it later on. In exceptional situations, for technical and / or safety reasons, the ticket printing service might be deactivated. In that case, the BUYER will have to be at the ticket booth of the concert venue at least one hour before the show starts in order to pick up the ticket/s. To collect them, the BUYER will have to show in the ticket booth:
• The ID / passport of the credit / debit card holder.
• The receipt of the purchase (purchase confirmation) sent through email.
D) The user will have a period of 14 (fourteen) calendar days from the purchase to withdraw, in which case the sums paid may be recovered. The exercise of such right of withdrawal shall not require any requirement or condition. None of the exceptions to the right of withdrawal provided for in Article 103 of Royal Legislative Decree 1/2007, of November 16th, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws shall be applicable, as these exceptions are not applicable to the act of contracting events provided hereunder. After this period has elapsed, the amount will only be exchanged or refunded in case of cancellation of the event. In any case of refund, the ORGANIZER shall only reimburse the amount of the ticket and shall not be responsible for any other expenses such as, but not limited to, hotels, travel, meals, subsistence allowance, etc. The inability of the BUYER to attend the show for reasons that are beyond the control of the ORGANIZER and / or error in making the purchase shall not be valid grounds for requesting a refund of the ticket price.
E) The ORGANIZER reserves the right to modify, if circumstances compel to it, the dates, schedules, programs or artists announced, and also the suspension of the show.
4. CONDITIONS OF ACCESS AND STAYING IN THE SHOW´S PREMISES
A) The ORGANIZER reserves the right to refuse admission. The minimum age to access to this events is 16. Any person under this age must be accompanied by a responsible adult.
B) For safety reasons, when entering the premises, the people attending the show could be searched. Objects that might be considered dangerous or forbidden by the current regulations concerning public events will be strictly forbidden. The following behaviors are strictly prohibited and thus will legitimize the prohibition to enter the premises.
– Bringing in alcoholic drinks, weapons or devices that could be used as such, flares, fireworks or similar objects.
– Bringing in and displaying banners, symbols, emblems or captions that imply incitement to violence.
– Being under the effects of alcoholic drinks, narcotics, psychotropic or similar substances.
C) The ORGANIZER will be entitled to deny the access or to eject out of the premises the ticket holder if he / she doesn’t abide by the present rules, or if he / she ignores the directions provided by the staff of the organization or the premises.
The organizer will also be entitled to deny the entrance to the premises if, sensibly, it can be predicted that if he / she stays in the premises there might be a situation of risk or danger for the holder or for the people attending the event. The holder will be personally responsible, in all cases, for his / her own actions and omissions if they cause injuries to a third party or any material damage.
D) The ORGANIZER reserves all the show´s image and intellectual property rights. Taking pictures, with or without flash, filming or recording are prohibited. The ticket holder accepts that he / she can appear in images taken in the premises taken by different media for further informative or promotional broadcasting, and he / she authorizes this use.
If there is video surveillance in the entrance, we inform that the images will become part of a file, of which the organizer will be responsible, with the purpose of controlling the access and safety of the event, as well as the settlement of any incident. He / she is entitled to exercise respect to the treatment of his / her data and has the right to access, modify, cancel and opposition to these in front of the event´s organizer.
I agree to receive the invoice in electronic format. In this case the invoice will be sent by email to the email address provided during the contracting process. In this case, the user may at any time revoke such authorization and request a paper invoice by simply sending an email to the following address [email protected]
5. USE OF THE PURCHASED TICKETS
A) The ticket/s purchased in this website must be guarded until the day of the event as if they were cash. The ticket BUYER or the person whose name appears in the ticket assume all the responsibilities in case of deceitfulness, photocopy or forgery of the ticket, losing all the rights that the ticket allowed him / her to enter to the premises.
B) The ORGANIZER won´t be responsible for any ticket loss or theft, nor for any personal belonging.
C) Purchasing the tickets doesn’t imply that the BUYER has the right to use them, or their contents, for advertising, marketing or promotion reasons (including contests, presents and / or drawing lots), if there isn’t an explicit and written consent from the ORGANIZER. Failure to comply with this prohibition will entitle the ORGANIZER to render the ticket /s useless and the start of all legal actions considered appropriate to claim for any damages that this behavior might have caused to the ORGANIZER.
6. PRIVACY POLICY OF THIS WEBSITE
According to the Organic Law regarding Protection of Personal Data and development regulations, the personal data of the BUYERS will be incorporated in an automated file of which the ORGANIZER, whose address is Stret Moià 14, 08006 Barcelona, Spain, is responsible.
Adding these data in the file will be done in order to complete the administration and monitoring of the buying and selling procedure until the show for which the tickets were purchased has ended. Only if the buyer had unticked the box allowing the treatment of his / her data for commercial purposes (in the “payment” phase of the purchase procedure) these data wouldn’t be used for further communications chosen by the ORGANIZER.

7. APPLICABLE LEGISLATION AND JURISDICTION
The competent jurisdiction of disputes that may arise from the interpretation or execution of this contract shall be the one corresponding to the place of residence of the consumer or user.
